UNIFORM CIVIL CODE-
Uniform Civil Code (UCC) is defined in our Constitution under Article 44 of Directive Principles of State Policy. It states that it is the duty of the state to secure for the citizens a Uniform Civil Code throughout the territory of India. In other words we can say that it means one country one rule is the need of the hour.
Apparently not. It is an erroneous perception that we have different personal laws because of religious diversity. As a matter of fact , a law may differ from state to state and a personal law may differ within 28 states and 9 union territories.
The preservation of legal diversity seems to be the reason that personal laws were included in the CONCURRENT LIST. “ Thus one nation , one law or the uniform civil code is not what our constitution really envisages.”
Don’t you think it is practically tough to come up with a common and a uniform set of rules for tremendous cultural diversity across various sections , castes , states etc? Interference in personal laws would tamper with the religious identity of the minorities and this is an unnecessary and an unwarranted intrusion into their religion and culture. How are we so sure that wrenching the laws and culture that already exist in a community and asking them to adopt alien laws can create goodwill or harmony among them?
I would like to conclude by saying, UNIFORM CIVIL CODE is divisible and will lead to social unrest and that it is against the spirit of the constitution which safeguards the rights of the citizens to follow their own culture and religion.
